OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of fire and explosion: Swellables Area: On or about May 12, 2013, and at times prior there to, where combustible rubber dust was present, the Donaldson Torit Dust Collection System lacked predeflagration systems for the detection, control and extinguishment of sparks/ferrous metals produced while employees were using automated or hand sanders on swellable packers.

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible: Swellables Area: On or about May 21, 2013, and at times prior thereto, employees operating hand and auto-sanders were voluntarily using 3M dust masks to protect them from rubber dust when using a hand and auto-sander to sand rubber-to-metal swellable packers.
