29 CFR 1926.1053(b)(15): Ladders were not inspected by a competent person for visible defects on a periodic basis and after an occurrence that could affect their safe use: Jobsite: On or about 06/25/2013 the ladders used to access the roof sections were not inspected by a competent person for visible defects on a periodic basis in the following instances: (a) The Werner 40 foot extension ladder used to access the upper roof had multiple damaged rungs and the rope to the pulley system was not installed. (b) The Werner 32 foot extension ladder used to access the window eyebrow roof had multiple damaged rungs and the rope to the pulley system was not installed.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired: Jobsite: On or about 06/25/2013, the Werner extension ladders had structural defects to the rungs and ropes were not installed on the pulley systems whereby the ladders were not immediately marked in a manner identifying it as defective or tagged with "DO NOT USE" and immediately removed from service until repaired.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): Jobsite: On or about 06/25/2013 two employees were observed performing construction activities on the window eyebrow and overhang of a residential structure and were not protected by a guardrail system, net system, or personal fall protection exposing the employees to a fall of approximately 22 feet. The Lincoln Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which were contained in the following OSHA inspections: inspection number 314915646, citation number 1, item number 1 and was affirmed as a final order on 01/04/2011, with respect to a workplace located at 11 Dedford Street; in OSHA inspection number 314920877, citation number 1, item number 1 and was affirmed as a final order on 04/04/2012 with respect to a workplace located at 321 Plainfield Street, Providence, RI; and again in OSHA inspection number 555979, citation number 1, item number 1 and was affirmed as a final order 09/04/2012 with respect to a workplace located at 131 Eustis Avenue, Newport, RI.
