29 CFR 1910.178(l)(3)(ii)(E): The employer did not ensure that each operator of a forklift completed the training consisting of workplace-related topics listed in 1910.178(l)(3)(ii)[A] - [I] of this section including, narrow aisles and other restricted places where the vehicle will be operated (1910.178(l)(3)(ii)(E)):     a) Workplace, Best Buy Sponsorship Booth, Gates F and G - Forklift training received by a forklift operator did not involve training in narrow or restricted spaces. An employee was operating a forklift inside a restricted vending area and contacted the vending booth, truss system; on, or about, 06/24/2013.        Note: In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR 1910.178(l)(4)(ii)(B): Refresher training in relevant topics shall be provided to the operator when: The operator has been involved in an accident or near-miss;    a) Workplace - An employee was operating a forklift inside a restricted vending area and contacted the vending booth, truss system. The employee continued to operate forklifts at the workplace without having received refresher training; on, or about, 12/17/2013.        Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
