OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees  On or about November 15, 2013 during construction activities at a work site located at 2100 Circle Drive, Cleveland, Ohio, the employer did not ensure an employee operating a JLG Model 800S, Serial No. 0300093586, aerial lift maintained a safe clearance from an energized 138kv power line.
