29 CFR 1926.251(a)(2)(ii): Rigging equipment was loaded in excess of its rated capacity: On October 10, 2019, employees were exposed to a struck by hazard while constructing a high-rise apartment building located at 1600 Euclid Ave., Cleveland, Ohio 44115. The employees were using a MDT-389 tower crane to lift six steel supports from the 34th floor to the street area below. The rigging crew used two synthetic nylon straps to lift the beams and the employer did not ensure that the straps were not loaded in excess of their rated capacity.

General-duty citation text
OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that on October 10, 2019, employees were exposed to struck-by hazards while using a MDT-389 tower crane to lower six steel supports from the 34th floor to the street area below: A. On October 10, 2019, the employer failed to ensure that the two synthetic nylon straps used to lower the steel supports were free from wear or damage that could compromise their ability to support the load exposing employees to a struck-by hazard; and B. On October 10, 2019, the employer failed to ensure that employees were clear of the area below the suspended load exposing employees to a struck-by hazard. A feasible and acceptable method to abate this hazard would be the following: A. Before use, ensure that slings and straps are free from wear or damage that could compromise their ability to support the load. B. Pre-plan each lift to ensure that employees are clear of the area below suspended loads.

On October 10, 2019, employees were exposed to a struck by hazard while constructing a high-rise apartment building located at 1600 Euclid Ave., Cleveland, Ohio 44115. The employees were using a MDT-389 tower crane to lift six steel supports from the 34th floor to the street area below. The rigging crew used two synthetic nylon straps to lift the beams and the employer did not ensure that the employee working on the ground was not working directly below the load.
