OSH ACT of 1970 Section (5)(a)(1): Section 5(A)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries from utility truck/step vans overturning or from the operator falling out of the cab of the truck due to the fact that the operator restraint systems (seat belt) provided on the truck was not used by the operator. Among other methods, one feasible and acceptable method to correct this hazard is for the employer to require and effectively enforce the use of the operator restraint systems Provided by the manufacturer of the utility truck/step van.    a) Worksite: Employees operating the utility trucks/step vans were observed not wearing the seat belt provided.

29 CFR 1910.305(g)(1)(iv): Flexible cords and/ or cables were used for purposes prohibited by paragraphs (A) through (F) of 29 CFR 1910.305(g)(1)(iv)(a):   a) Office Container: Instead of hard wiring the interior of an office space created in the rear of a 40 foot intermodal container, the employer ran two 120 volt extension cords from a portable generator to provide power two (2) relocatable power taps.  b) Office Container: To provide power to relocatable power taps inside the office area of the container, the employer ran two (2) 120 volt extension cords through two (2) holes of 1.5 inches diameter each.   ABATEMENT CERTIFICATION IS REQUIRED

29 CFR 1910.303(b)(2): Listed or labeled electrical equipment was not used or installed in accordance with instructions included in the listing or labeling:   North end of the Office Container: A Tower Manufacturing Corp 120 volt relocatable power tap, listed for carrying high concentrations of low powered loads; such as computers, printers, TVs, etc was  instead used to provide power to a Vornado portable heater which is a high powered load.
