29 CFR 1926.300(a): Hand tool(s), power tool(s) or similar equipment were not maintained in a safe condition: a) 3rd St. & Virginia Avenue, SW - Workers were observed operating a Mikasa Series Model MVC-82VH/VHW one-way plate compactor with a Honda Gx160 engine to level the ground surface that had a damaged muffler and a non-manufacturer handle which to could lead to excess noise exposure leading to hearing loss and hand-arm vibration syndrome (HAVS), on or about December 19, 2013. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact: (a) 3rd St. & VA Avenue, SW - A worker, who is required to wear a 3M 8511 N95 respirator, was observed cutting concrete creating a dusty environment while the respirator was hanging from his neck, on or about December 19, 2013. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
