29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was required to use the respirator in the workplace: (Construction Reference 1926.103)    (a) Millersville University South Quad Student Housing - The employer did not ensure that a medical evaluation was conducted for an employee assigned to dry cut bricks for the mason's.  Dry cutting bricks is a task which required the use of a respirator/dust mask on or about March 27, 2014.    Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.28(a): The employer did not require employees to wear appropriate personal protective equipment in all operations where there was exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to employees.    (a) Millersville University South Quad Student Housing - The saw man was did not wear a respirator when he dry cut brick for the masons as required in 29 CFR 1910.134(a)(2).  The employee was exposed to hazards of breathing dust containing silica on or about March 27, 2014.    Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
