OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a) In the production area, on or about April 24, 2014, four emergency stop pushbuttons associated with the overhead conveyor system were found to be inoperable, resulting in a struck-by and caught-in hazard. Emergency stop pushbuttons are required to be continuously operable and readily accessible as specified in NFPA 79 Section 10.7.1.1.

29 CFR 1910.134(e)(2)(ii): The medical evaluation did not obtain the information requested by the questionnaire in Sections 1 and 2, Part A of Appendix C of 29 CFR 1910.134: (a) In the production area, on or about April 24, 2014 and at times prior to, employees required to wear a respirator were medically evaluated and fit tested; however, the information required by the questionnaire in Sections 1 and 2, Part A of Appendix C of 29 CRF 1910.134 was not provided by the employees prior to the medical evaluation, resulting in a respiratory hazard.

29 CFR 1910.1026(l)(1)(iii): The employer did not include chromium (VI) in the hazard communication program established to comply with the Hazard Communication Standard (HCS), ensure that each employee had access to labels on containers of chromium (VI) and to safety data sheets, and was trained in accordance with the requirements of HCS and 29 CFR 1910.1026: (a) In the Blasting Area, on our about April 23, 2014, employees were required to work with Steel Shot which contains chromium (IV) without training. Chromium (VI) training was not included in the hazard communication program, resulting in a health hazard.
