OSH ACT of 1970 Section (5)(a)(1):   The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees are exposed to struck-by hazards from vehicular traffic because operators of vehicles are allowed to drive with their forward vision fully or partially obscured, including drivers of loaders transporting two hay bales.

29 CFR 1910.1200(e)(1):  This provision is applicable to agricultural employment by 1928.21.     29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:     Worksite located at 12723 V Road, Shelby, NE and throughout the company:  The employer did not develop and maintain a written hazard communication program.  The employer uses a number of chemicals such as but not limited to motor oil, petroleum based lubricants, and sanitation chemicals.           Abatement certification is required for this violation.  The abatement certification sheet is enclosed with the citations.
