29 CFR 1928.51(b)(2)(i)(B):     The employer failed to ensure that each employee tightens the seatbelt sufficiently to confine the employee to the protected area provided by the ROPS.    Worksite located at 12723 V Road, Shelby Ne:  The employer is failing to ensure employees operating loaders and similar equipment are utilizing seatbelts.      Or in the alternative:       Section 5(a)(1) of the Occupational Safety and Health Act of 1970:      The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees are exposed to crushing hazards associated with failing to properly use seatbelt restrain devices while operating front end loaders (Caterpillar 924k and 930k).         AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS:      (a)  Develop and implement written procedures requiring operators of loaders or similar equipment to wear provided seat belts when operating these vehicles.      (b)  Develop and implement a disciplinary action program and procedures to ensure that employees wear seat belts while operating these vehicles.      (c)  Take precautions with regards to the vehicles to prevent an accident from happening including but not limited to, ensuring all vehicle operators are trained in the safe operation of the vehicle.       Double Dutch Dairy LLC  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1928.51(b)(2)(I)(B), which was contained in OSHA inspection number 981600, citation number 1, item number 1 and was affirmed as a final order on November 26, 2014, with respect to a workplace located at 12723 V Road, Shelby, NE.    Abatement certification is required for this violation.  The abatement certification sheet is enclosed with the citations.
