OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, on or about July 30, 2014, the employer did not ensure that Rig #11 was rigged up in a safe manner prior to commencing well operations.  Rig #11 was operated without an operable safety device to prevent the traveling block from striking the crown block.  Alternative measures were not utilized in lieu of an operable crown out device, exposing employees to struck-by hazards.

29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards:    On or about July 30, 2014, the employer did not ensure that a guard rail was installed by the driller's workstation. This condition exposed employees to fall hazards exceeding 4 feet.    THE CHOCTAW SERVICES LLC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 1910.23(C)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 960638, CITATION NUMBER 1, ITEM NUMBER 1 AND WAS AFFIRMED AS A FINAL ORDER ON 5/15/2014, WITH RESPECT TO A WORKPLACE LOCATED 3.5 MILES WEST OF PYOTE, TX.
