29 CFR 1926.651(c)(2): Means of egress from trench excavations. A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees. (a) On or about September 11th, 2014, a ladder was resting on the supports of the trench box and not inside the trench box with its feet on the bottom of the trench for employees to have means of egress out of the excavation.

29 CFR 1926.652(g)(2): Additional requirement for shield systems used in trench excavations. Excavations of earth material to a level not greater than 2 feet (.61 m) below the bottom of a shield shall be permitted, but only if the shield is designed to resist the forces calculated for the full depth of the trench, and there are no indications while the trench is open of a possible loss of soil from behind or below the bottom of the shield. (a) On or about September 11, 2014, employees were exposed to cave-in hazards in that the excavation of soil below the trench box shield was greater than two feet.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. (a) On or about September 11th, 2014, employees of Willkomm Excavating and Grading, Inc. were exposed to cave-in while conducting pipe connections in an unprotected trench. The competent person determined that the trench required cave-in protection, but failed to have the trench protection installed correctly. WILLKOMM EXCAVATING AND GRADING, INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.651(k)(2), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 110918, CITATION NUMBER 1, ITEM NUMBER 1 AND WAS AFFIRMED AS A FINAL ORDER ON 4/3/12, WITH RESPECT TO A WORKPLACE LOCATED AT 10600 WEST LAYTON AVENUE, GREENFIELD, WI 53228.
