29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  (a) Front side, new residential construction located at 5241 Byers Landing Way, Johns Creek, GA 30024: The ladder provided was not secured to the structure and did not extend at least 3 feet above the working surface to allow for safe access on and off the second floor. Employees accessing this ladder were exposed to falls of approximately 12-feet, 2-inches to the lower level.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.  (a) Second floor, new residential construction located at 5241 Byers Landing Way, Johns Creek, GA 30024: Employees using pneumatic Hitachi (Model NR83A2-S1) Framing Nail Guns with 3-inch plastic collated strip nails at 120 PSI engaged in residential framing activities were not protected from eye injuries when safety glasses or goggles were not worn.  Bernardino Botello Lopez, Dba BBL, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number #924799, citation number 1, item number 1 and was affirmed as a final order on 09/30/2013, with respect to a workplace located at 4243 Hardy Avenue, Smyrna, GA 30080.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  (a) Second floor, new residential construction located at 5241 Byers Landing Way, Johns Creek, GA 30024: Employees engaged in residential framing activities at heights of approximately 12-feet, 2-inches were not provided with a fall protection system.  Bernardino Botello Lopez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number #924799, citation number 1, item number 3 and was affirmed as a final order on 09/30/2013, with respect to a workplace located at 4243 Hardy Avenue, Smyrna, GA 30080.
