The employer has failed to submit abatement certification and documentation within ten days of the abatement date, August 6, 2015, for a violation of 29 CFR 1910.23(c)(1), issued as citation 1, item 1, and described as follows: On or about 01/16/15, at the workplace in the Pool Area, an employee was working off a ledge that was approximately 20 feet high and 11 inches wide, without the protection of guardrails or appropriate fall protection. On or about 05/01/15, at the workplace in the Front Lobby Area, an employee was working off an awning that was approximately 8 feet high with a 10/12 pitch, without the protection of guardrails or appropriate fall protection. b. The employer has failed to submit abatement certification and documentation within ten days of the abatement date, August 6, 2015, for a violation of 29 CFR 1910.28(d)(12), issued as citation 1, item 2a, and described as follows: On or about 01/16/15. at the workplace in the Pool Area, employees used a tubular welded frame scaffold that had not been erected by personnel competent in scaffolding. c. The employer has failed to submit abatement certification and documentation within ten days of the abatement date, August 6, 2015, for a violation of 29 CFR 1910.28(e)(5), issued as citation 1, item 2b, and described as follows: On or about 01/16/15, at the workplace in the Pool Area, employees worked from scaffolding approximately 25 feet high that did have any wire mesh or enclosure to protect an employee standing at the base of the scaffold from falling material. d. 29 CFR 1910.29(a)(4)(iii): Where leveling of the elevated work platform is required, screw jacks or other suitable means for adjusting the height shall be provided in the base section of each mobile unit. a. On or about 01/16/15, at the workplace in the Pool area, a 25 foot scaffold was used by employees without screw jacks or other suitable means for adjusting the height, when leveling was required. A piece of scrap wood had been placed under one of the scaffolds casters in an attempt to level the work surface, creating a potentially unstable footing.
