29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 paragraph (b) or (c) of this section. a) 2151 Interstate Drive, Opelika AL; On or about January 14, 2015 the employer exposed employees to cave-in hazards in that employees were allowed to work inside of a trench measuring seven to nine feet deep, fifteen feet wide, and fifteen feet in length that was dug in class "c" soil. The employer had not complied with the standard in that employees were not protected from cave-ins by an adequate protective system and the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical (thirty-four degrees measured to the horizontal).

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury, in that: a) On or about January 14, 2015, at 2151 Interstate Drive, Opelika AL, employees entered and worked in a trench measuring seven to nine feet deep that was not protected from cave-ins by an adequate protective system. Employees had not been provided effective information and training on recognizing and avoiding cave-in hazards on the work site.
