29 CFR 1910.178(l)(4)(ii)(B): Refresher training, including an evaluation of the effectiveness of that training, was not provided to the operator when the operator has been involved in an accident or near-miss incident:  a) On or about April 29, 2015, the employer did not ensure that a tugger operator who had been involved in a near miss incident received refresher training.  On April 23, 2015, a tugger operator struck a piece of equipment located at machine #618 with one of the cars being pulled.      In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
