29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)  Employees engaged in stucco mixing and application activities at 6601 E. Frontage Rd., Merriam, Kansas were exposed to injury/illness from dermal, ingestion, and inhalation hazards from exposure to hazardous chemicals.  The employer had not developed or implemented a written hazard communication program to ensure that employees were aware of the hazards associated with the chemicals with which they work.  Hazardous chemicals used at the site included but were not limited to dryvit Primus DM.

Frontage Rd., Merriam, Kansas were exposed to injury/illness from dermal, ingestion, and inhalation hazards from exposure to hazardous chemicals.  A copy of the required safety data sheet for dryvit Primus DM was not maintained at the construction site exposing employees to dermatitis and burns.

Frontage Rd., Merriam, Kansas exposed to injury/illness from dermal, ingestion, and inhalation hazards from exposure to hazardous chemicals. Employees had not been provided with training or information regarding the hazardous chemicals with which they work.  Hazardous chemicals such as dryvit Primus DM stucco compound were used at the construction site.

Frontage Road in Merriam, KS, the supported scaffold was not fully planked on any of the working levels exposing employees to an incomplete walking/working surface and subsequent fall hazard of greater than 25 feet on the upper working level.

Frontage Road in Merriam, KS, the supported scaffold was not fully cross braced in all sections exposing employees to a scaffold collapse and subsequent fall hazard of greater than 25 feet from the upper working level.  Cross bracing was missing as follows:      a)  Third and fourth tier, next to building, south tower.      b)  Third tier, next to building, second tower from south end.          c)  Second tier, away from building, third tower from south end.      d)  Second, third and fourth tier, next to building, third tower from south end.      e)  Second and fourth tier, next to building, fourth tower from the south end.      f)  Second, third, and fourth tier, next to building, fifth tower from the south end.      g)  Second tier, next to building, north tower.      h)  Third tier, away from building, north tower.      i)  Second tier, next to building, second tower from north end.      j)  Third tier, away from building, second tower from north end.      k)  Fourth tier, next to building, second tower from north end.      l)  Second tier, next to building, third tower from north end.      m)  Third tier, away from building, third tower from north end.      n)  Fourth tier, next to building, third tower from north end.      o)  Fifth tier, next to building, third tower from north end.

Frontage Road in Merriam, KS, employees were exposed to a fall hazard of greater than 25 feet while climbing scaffold frames to gain access to upper working levels.  Portable ladders were not provided.

Frontage Road in Merriam, KS, employees engaged in applying stucco to an exterior wall of the building with the use of scaffolding were exposed to a fall hazard of greater than 25 feet from the upper working platform to the ground below. The employees were exposed in that fall protection was not used.
