29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired:    This violation occurred on or about August 5, 2015, at a workplace located at 1410 S. Goliad Street, Rockwall, TX; where at least three (3) employees used broken side rail ladder to access/egress the roof and were exposed to the hazard of falling to the ground below.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:     This violation occurred on or about August 5, 2015, at a workplace located at 1410 S. Goliad Street, Rockwall, TX; where:    a)  At least three (3) employees, who were working on the roof of building #6, were not protected from falling to the ground below.    b) At least six (6) employees, who were working on the roof of building #9, were not protected from falling to the ground below.      The Roberto Fernandez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 315184275, citation number 1, item number 1 and was affirmed as a final order on 3/22/2011, with respect to a workplace located at 116 Port St. Claire, Aransas Pass, TX.
