OSH ACT of 1970 Section (5)(a)(1): The employer does not furnish to each of his employees employment and a place of employment which are free from the recognized hazards of being struck-by which are causing or likely to cause death or serious physical harm to employees:   a. This violation occurred on or about December 3, 2015, and times prior thereto, in the Galvanizing Dept. where employees were allowed to operate a Gimeco 5-ton overhead crane, ID# GH2, which had not been inspected annually with records maintained. Hazardous conditions disclosed were not repaired before continued use of the crane.   b. This violation occurred on or about December 3, 2015, and times prior thereto, in the Galvanizing Dept. where employees were allowed to operate a Gimeco 5-ton overhead crane, ID# GH3, which had not been inspected annually with records maintained. Hazardous conditions disclosed were not repaired before continued use of the crane.   c. This violation occurred on or about December 3, 2015, and times prior thereto, in the Galvanizing Dept. where employees were allowed to operate a Gimeco 5-ton overhead crane, ID# GH4, which had not been inspected annually with records maintained. Hazardous conditions disclosed were not repaired before continued use of the crane.  d. This violation occurred on or about December 3, 2015, and times prior thereto, in the Galvanizing Dept. where employees were allowed to operate a Gimeco 5-ton overhead crane, ID# GH5, which had not been inspected annually with records maintained. Hazardous conditions disclosed were not repaired before continued use of the crane.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  a. On or about December 3, 2015, and times prior thereto, employees in the fabrication area were exposed to a struck-by hazard when operating a Press Well notching machine, Model NM80, ID# 1, without one or more methods of machine guarding to protect the operator from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks.  b. On or about December 3, 2015, and times prior thereto, employees in the fabrication area were exposed to a struck-by hazard when operating a Press Well notching machine, Model NM80, ID# 2, without one or more methods of machine guarding to protect the operator from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks.  c. On or about December 3, 2015, and times prior thereto, employees in the fabrication area were exposed to a struck-by hazard when operating a Press Well notching machine, Model NM80, ID# 3, without one or more methods of machine guarding to protect the operator from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks.  d. On or about December 3, 2015, and times prior thereto, employees in the fabrication area were exposed to a struck-by hazard when operating a Press Well notching machine, ID# NOT3, without one or more methods of machine guarding to protect the operator from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks.  e. On or about December 3, 2015, and times prior thereto, employees in the fabrication area were exposed to a struck-by hazard when operating a Ficep Ironworker punch, Model TACO 1050 PLC/SP 100, S/N 33544-Punch 3/C, without one or more methods of machine guarding to protect the operator from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks.  f. On or about December 3, 2015, and times prior thereto, employees in the fabrication area were exposed to a struck-by hazard when operating a Ficep Ironworker punch, Model TACO 1050 PLC/SP 100, S/N 33546-Punch 2/B, without one or more methods of machine guarding to protect the operator from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks.  g. On or about December 3, 2015, and times prior thereto, employees in the fabrication area were exposed to a struck-by hazard when operating a Ficep Ironworker punch, Model TACO 1050 PLC/SP 100, S/N 33547-Punch 1/A, without one or more methods of machine guarding to protect the operator from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks.
