29 CFR 1910.147(c)(4)(ii): The energy control procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, including, but not limited to items (a) through (d) of this section: a) On or about January 25, 2016, the employer did not ensure there was a specific energy control procedure for pallet dismantler #2 that clearly and specifically outlined the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, including the following items: A) A specific statement of the intended use of the procedure, B) Specific procedural steps for shutting down, isolating, blocking and securing machines or equipment to control hazardous energy, C) Specific procedural steps for the placement, removal and transfer of lockout devices or tagout devices and the responsibility for them, and D) Specific requirements for testing a machine or equipment to determine and verify the effectiveness of lockout devices, tagout devices, and other energy control measures. In accordance with 29CFR 1903.19(d), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.147(c)(7)(i)(A): Authorized employee(s) did not receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control: (a) On or about January 25, 2016, an employee engaged in a servicing and maintenance activity, such as changing a saw blade on pallet dismantler #2, was not trained at the authorized level in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control. The employee was exposed to laceration and amputation injuries due to caught-in and struck-by hazards in the event of an unexpected start up of the pallet dismantler. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6): a) On or about January 25, 2016, before changing a saw blade at the pallet dismantler #2, the employer failed to implement the following energy control application steps: 1) Know the type and magnitude of the energy, the hazards of the energy to be controlled and the method or means to control the energy, 2) Physically locate and operate energy-isolating devices in such a manner as to isolate the machine or equipment from the energy source(s), 3) Affix lockout/tagout devices to each energy isolating device, 4) Following the application of lockout or tagout devices to energy isolating devices, all potentially hazardous stored or residual energy shall be relieved, disconnected, restrained, and otherwise rendered safe, and 5) Verify isolation and de-energization of machinery have been accomplished prior to starting the maintenance and/or servicing work. The employee was exposed to laceration and amputation injuries due to caught-in and struck-by hazards in the event of an unexpected start up of the pallet dismantler. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
