OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to falling from a step-ladder while attempting to gain access to storage racks.  (a)Wilson Trailer Company @ 3602 Broadway, Yankton, SD 57078: On and prior to March 4, 2016, the employer did not ensure employees were protected from fall hazards while utilizing a fiberglass Louisville eight foot step-ladder to gain access to racks storing bundles of aluminum extrusion. Employees would climb up the ladder and step off onto the racking system which created a side load on the step-ladder. The ladder can be destabilized and shift, exposing the employee to a fall hazard. The ladder was not used as intended by the manufacturer. This condition exposed employees to a fall hazard of approximately 8 feet.  Among other methods, one feasible method of abatement is to follow ANSI A14.5 2007, Subparagraphs 9.3.6 and 9.3.7. Side Loading. Portable ladders are not designed for excessive side loading, and such abuse of the ladder shall be avoided. The ladder shall be kept close to the work. The user shall not overreach, but shall descend and relocate the ladder instead. When using a ladder, the user shall never push or pull unless the ladder is properly secured. 9.3.7 Climbing Ladders. When ascending or descending the ladder, the user shall face the ladder and maintain a firm hold on the ladder. The user shall not climb onto a ladder from the side, from one ladder to another, or from a swing-stage to a ladder, unless the ladder is secured against sideways motion or has been tied to the structure.

The walk-way was missing one side of the guard rail system.  This condition exposed the employee to a fall hazard of approximately 11 feet.     Abatement Note:  The following is provided to assist in the abatement of this hazard:     (a)A standard railing shall consist of top rail, intermediate rail, and posts, and shall have a vertical height of 42 inches nominal from upper surface of top rail to floor, platform, runway, or ramp level. The top rail shall be smooth-surfaced throughout the length of the railing. The intermediate rail shall be approximately halfway between the top rail and the floor, platform, runway, or ramp. The ends of the rails shall not overhang the terminal posts except where such overhang does not constitute a projection hazard.     (b) A standard toeboard shall be 4 inches nominal in vertical height from its top edge to the level of the floor, platform, runway, or ramp. It shall be securely fastened in place and with not more than 1/4-inch clearance above floor level. It may be made of any substantial material either solid or with openings not over 1 inch in greatest dimension.
