29 CFR 1910.107(c)(6): Wiring type approved. Electrical wiring and equipment not subject to deposits of combustible residues but located in a spraying area as herein defined shall be of explosion-proof type approved for Class I, group D locations and shall otherwise conform to the provisions of subpart S of this part, for Class I, Division 1, Hazardous Locations. Electrical wiring, motors, and other equipment outside of but within twenty (20) feet of any spraying area, and not separated therefrom by partitions, shall not produce sparks under normal operating conditions and shall otherwise conform to the provisions of subpart S of this part for Class I, Division 2 Hazardous Locations. a) On or about June 1, 2017, the electrical outlets in the 123 W. Main Street building Spray Area were not approved for Class 1, Division 2 locations. Choice Brands Adhesives F-151 is a flammable liquid that was being applied by spray gun in the 123 W. Main Street building Spray Area. The spray adhesive was being applied within 10 feet of the electrical outlets.

29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use. The employer shall include in the program the following provisions of this section, as applicable: a) On or about May 16, 2017, the employer had not established or implemented a written respiratory protection program for the employees required to wear respiratory protection. Employees spraying adhesives and wood finishing products were required to wear half mask cartridge respirators. An effective respiratory protection includes, but is not limited to the following: 1. Procedures to provide appropriate respiratory protection for the workplace tasks 2. Employee medical evaluations 3. Employee fit testing procedures for tight fitting respirators 4. Proper respirator usage procedures 5. Procedures and schedules for cleaning, storing and maintaining respirators 6. Schedule for changing respirator cartridges 7. 29 CFR 1910.134 Respiratory Protection Appendix D training for employees voluntarily wearing respiratory protection 8. Employee training on the workplace hazards requiring respiratory protection 9. Employee training on the proper usage, maintenance and storage of their respirators 10. Evaluation of the respiratory protection program to ensure effectiveness 11. Designation of a trained program administrator to oversee and evaluate the respiratory protection program

The training shall be repeated at least annually. a) On or about May 16, 2017, employees using Sherwin-Williams Sher-Wood Fast Dry Vinyl Sealer T67F6 and Sherwin-Williams Sher-Wood Hi-Bild Precat Lacquer T77F57, which contains formaldehyde, had not received formaldehyde specific training. Effective Formaldehyde employee training includes, but is not limited to the following: 1. Discussion on the contents of the 29 CFR 1910.1048 Formaldehyde standard 2. Discussion on the contents of the safety data sheets for the materials containing formaldehyde 3. A description of the potential health effects associated with exposure to formaldehyde 4. A description of the signs and symptoms associated with exposure to formaldehyde 5. Instructions to immediately report to the employer any adverse signs or symptoms the employee believes related to formaldehyde exposure 6. Description of work tasks where formaldehyde exposure may occur 7. Description of the work practices appropriate to limit exposure to formaldehyde 8. Description of the personal protective equipment appropriate for work tasks involving formaldehyde and the proper usage and care the personal protective equipment 9. Instructions for handling formaldehyde containing materials spills, emergencies and cleanup procedures 10. 29 CFR 1910.95(c)(1): The employer shall administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent. For purposes of the hearing conservation program, employee noise exposures shall be computed in accordance with appendix A and Table G-16a, and without regard to any attenuation provided by the use of personal protective equipment. a) On or about June 1, 2017, the employer had not implemented a continuing, effective hearing conservation program for the CNC Operator exposed to a 469 minute noise dosage of 60.6% which is equivalent to an 8 hour time weighted average noise level of 86.4 dBA.
