29 CFR 1910.178(q)(6): Industrial trucks shall not be altered so that the relative positions of the various parts are different from what they were when originally received from the manufacturer, nor shall they be altered either by the addition of extra parts not provided by the manufacturer or by the elimination of any parts, except as provided in paragraph (q)(12) of this section. Additional counterweighting of fork trucks shall not be done unless approved by the truck manufacturer: (a) Facility, 200 Utah Street, Harmony, PA: On or before July 21, 2017 powered industrial trucks used by employees had the backrests removed and were not maintained in the same condition as originally received from the manufacturer. The backrests shielded the ends of the carriage to prevent the forks from sliding off the ends during positioning changes. An employee was operating a Nissan forklift and was attempting to reposition the forks on the lift when one of the forks slid off the end of the carriage and landed on the employee's foot. The crushing injuries resulted in the amputation of the toes and trans-metatarsal on the employee's right foot.

29 CFR 1904.39(a)(2): Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, the employer did not report the in-patient hospitalization, amputation, or loss of an eye to OSHA: (a) Facility, 19 Leonberg Road, Cranberry Township, PA: The employer did not report the in-patient hospitalization and amputation that was the result of a work-related incident that occurred on July 21, 2017 within twenty-four hours after such hospitalization and amputation occurred. The employer reported the incident to OSHA on July 27, 2017.
