29 CFR 1926.103: The requirements applicable to construction work under this section are identical to those set forth at 29 CFR 1910.134 of this chapter.  29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  (a) On September 6, 2017, Doherty, Giannini, Reitz Construction Inc. did not provide a medical evaluation to employee(s) before 3M 5000 series half-mask, negative pressure respirators were allowed to be worn voluntarily in the workplace.

29 CFR 1910.1200(g)(8): The employer did not ensure that safety data sheets were readily accessible to the employees in their work area during each work shift:  a) On September 6, 2017, Doherty, Giannini, Reitz Construction, Inc. did not ensure that copies of Safety Data Sheets were accessible to the employees at the worksite including, but not limited to: clay pipe, USG all purpose joint compound, and Logan pipe joint lubricant.
