OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to a fall hazard while elevated on a telehandler.  a)   113 Passaic Avenue, Kearny, NJ- Employee was elevated at a height of approximately 6 feet while standing on a Telehandler grout hog fork attachment exposing the employee to a fall hazard; on or about 12/21/17.

29 CFR 1926.452(c)(2): Frames and panels were not braced by cross, horizontal, or diagonal braces, or combination thereof, which secure vertical members together laterally, and automatically square and align the vertical members so that the erected scaffold is always plumb, level, and square.  a) Tubular welded scaffold- Employees were working on a tubular welded scaffold that was missing cross braces; on or about 1/11/18.
