29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    a- 46 & 48 Havens Avenue, Lakewood NJ: Company workers were exposed to fall hazards in excess of 13 feet to the ground surface below when using an unsecured ladder whose side rails did not extend at least 3 feet above the upper landing surface being accessed and egressed. Condition observed on or about 02/27/18.     NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired:    a- 46 & 48 Havens Avenue, Lakewood NJ: Company workers were exposed to fall hazards in excess of 13 feet to the ground surface below when using damaged aluminum extension ladders to access and egress active walking and working surfaces at the worksite.  Condition observed on or about 02/27/18.     NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor was an alternative fall protection measure provided:    a- 46 & 48 Havens Avenue, Lakewood NJ: Company workers either: wearing full body harnesses with no lanyards attached, not using fall protection, wearing full body harnesses with lanyards improperly attached to the them, wearing full body harnesses with visibly damages lanyards attached to them, etc. were exposed to fall hazards in excess of 13 feet to the ground surface below when walking/working from a residential structure's pitched roofs.  Condition observed on or about 02/27/18.     American Dream Carpentry, Inc. was previously cited for a Serious violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1181822, citation number 1, item number 3 and was affirmed as a final order on 01/04/17, with respect to a workplace located at Building 43 Harbortown Boulevard, Perth Amboy NJ.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
