OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to struck-by hazards while moving railcars with an alloy steel chain attached to a hook welded to the bucket of a backhoe loader.    a) Facility, 2483 Trenton Avenue, Williamsport, PA - Employees moved 25-35 ton railcars with an alloy steel chain connected to the railcar and a clevis grab hook welded to the bucket of a CASE Construction Equipment Backhoe Loader Model 580C (Serial No. 8976736). The altered clevis grab hook (branch was sheared), the alloy steel chain without rated load, and the weld on the bucket (altered hook and bucket tensile strength) created an unknown maximum rated load for the towing configuration exposing employees to struck-by hazards, on or about November 9, 2018.    In accordance with 29 CFR 1903.19(c), abatement certification is required for the violation.

29 CFR 1910.23(b)(9): Ladders were not inspected before the initial use in each work shift, or more frequently as necessary, to identify any visible defects that could cause injury:  a) Facility, 2486 Trenton Avenue, Williamsport, PA - Employees used a Louisville Fiberglass Step Stool Platform Model L-4031-03 for railcar access and egress that had not been inspected before initial use each workday as evidenced by visible defects that included a damaged tread and a broken support strut. Employees were exposed to a fall hazard, observed on or about November 9, 2018.  In accordance with 29 CFR 1903.19, abatement certification is not required for this violation as the hazardous condition was corrected during the inspection.

Employees were exposed to a fall hazard, observed on or about November 9, 2018.  In accordance with 1903.19, abatement certification is required for this violation.

29 CFR 1910.178(a)(4): Modifications or additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals were not changed accordingly:  a) Facility, 2486 Trenton Avenue, Williamsport, PA - Employees were lifted vertically and worked on railcar roofs and sides from a "shop made" personnel basket placed on the forklift tines and attached to the load backrest of a Doosan 7 Series Pneumatic LP Forklift Model G30N-7 (Serial #FGA15-1330-0035S) without the manufacturer's prior written approval to operate the forklift in that condition. Employees were exposed to fall hazards, on or about November 9, 2018.  In accordance with 29 CFR 1903.19, abatement certification is required for this violation.

29 CFR 1910.178(a)(5): If the truck is equipped with front-end attachments other than factory installed attachments, the user shall request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered:  a) Facility, 2486 Trenton Avenue, Williamsport, PA - Employees were lifted vertically and worked on railcar roofs and sides from a "shop made" personnel basket placed on the forklift tines and attached to the load backrest of a Doosan 7 Series Pneumatic LP Forklift Model G30N-7 (Serial #FGA15-1330-0035S) that lacked markings providing the modifications to the lifting capacity created by the front-end attachment. Employees were exposed to fall hazards, on or about November 9, 2019.  In accordance with 29 CFR 1903.19, abatement certification is required for this violation.
