29 CFR 1910.1026(c): The employer shall ensure that no employee is exposed to an airborne concentration of chromium (VI) in excess of 5 micrograms per cubic meter of air (5 ug/m^3), calculated as an 8-hour time-weighted average (TWA): At a facility located at W6365 Discovery Drive, Appleton, WI 54914; the employer did not ensure no employees was exposed to an airborne concentration of chromium (VI) in excess of 5 ug/m^3, calculated as an 8-hour TWA when: a) On April 30, 2019, a Painter employee in the large painting spray booth was exposed to an 8-hour time-weighted average (TWA) of chromium (VI) at a level of 315 ug/m^3. This exceeded the 8-hour TWA PEL of 5 ug/m^3. The sample was collected over 84 minutes during one shift with 0 ug/m^3 assumed for the unsampled 396 minutes of an 8-hour shift. b) On April 30, 2019, a Painter employee in the large painting spray booth was exposed to an 8-hour time-weighted average (TWA) of chromium (VI) at a level of 92 ug/m^3. This exceeded the 8-hour TWA PEL of 5 ug/m^3. The sample was collected over 83 minutes during one shift with 0 ug/m^3 assumed for the unsampled 397 minutes of an 8-hour shift. c) On April 30, 2019, a Painter employee in the large painting spray booth was exposed to an 8-hour time-weighted average (TWA) of chromium (VI) at a level of 234 ug/m^3. This exceeded the 8-hour TWA PEL of 5 ug/m^3. The sample was collected over 66 minutes during one shift with 0 ug/m^3 assumed for the unsampled 414 minutes of an 8-hour shift. d) On April 30, 2019, a Painter employee in the large painting spray booth was exposed to an 8-hour time-weighted average (TWA) of chromium (VI) at a level of 39 ug/m^3. This exceeded the 8-hour TWA PEL of 5 ug/m^3. The sample was collected over 63 minutes during one shift with 0 ug/m^3 assumed for the unsampled 417 minutes of an 8-hour shift. e) On April 30, 2019, a Painter Assistant employee in the large painting spray booth was exposed to an 8-hour time-weighted average (TWA) of chromium (VI) at a level of 216 ug/m^3. This exceeded the 8-hour TWA PEL of 5 ug/m^3. The sample was collected over 74 minutes during one shift with 0 ug/m^3 assumed for the unsampled 406 minutes of an 8-hour shift. f) On April 30, 2019, a Painter Assistant employee in the large painting spray booth was exposed to an 8-hour time-weighted average (TWA) of chromium (VI) at a level of 52 ug/m^3. This exceeded the 8-hour TWA PEL of 5 ug/m^3. The sample was collected over 75 minutes during one shift with 0 ug/m^3 assumed for the unsampled 405 minutes of an 8-hour shift. g) On April 30, 2019, a Painter Assistant employee in the large painting spray booth was exposed to an 8-hour time-weighted average (TWA) of chromium (VI) at a level of 259 ug/m^3. 29 CFR 1910.1026(f)(1)(ii): Where painting of aircraft or large aircraft parts is performed in the aerospace industry, the employer shall use engineering and work practice controls to reduce and maintain employee exposure to chromium (VI) to or below 25 µg/m^3 unless the employer can demonstrate that such controls are not feasible. The employer shall supplement such engineering and work practice controls with the use of respiratory protection that complies with the requirements of paragraph (g) of this section to achieve the permissible exposure limit (PEL): At a facility located at W6365 Discovery Drive, Appleton, WI 54914; the employer did not use feasible engineering and work practice controls to reduce and maintain employee exposures to chromium (VI) to or below 25 ug/m^3 when: a) On April 30, 2019, a Painter employee in the large painting spray booth was exposed to an 8-hour time-weighted average (TWA) of chromium (VI) at a level of 315 ug/m^3. This exceeded the 8-hour TWA PEL of 25 ug/m^3. The sample was collected over 84 minutes during one shift with 0 ug/m^3 assumed for the unsampled 396 minutes of an 8-hour shift. b) On April 30, 2019, a Painter employee in the large painting spray booth was exposed to an 8-hour time-weighted average (TWA) of chromium (VI) at a level of 92 ug/m^3. Applicable administrative and engineering controls may include, but are not limited to the following: 3) Reduce/eliminate exposures from overspray due to: i) Upstream overspray generated by other painting teams (Painters and Assistant Painters). Stagger the work of painting teams so that no painting team is downstream of another painting team while they spray coat with primer. ii) Painting teams spray coating primer on mirror sides of the plane at the same time. Stagger the work of painting teams so that painter teams are not directing overspray into the work areas of other painting teams. iii) Employees working in the overspray of other employees. Minimize the number of employees creating and being exposed to overspray in the spray booth at one time. Fewer employees creating overspray at one time: a) allows for the ventilation system to more efficiently clear overspray from the air, and b) reduces the number of people exposed to the overspray.

This determination shall be made in accordance with either paragraph (d)(2) or paragraph (d)(3) of this section: At a facility located at W6365 Discovery Drive, Appleton, WI 54914; the employer did not determine the 8-hour TWA exposures for each employee exposed to chromium (VI). The employer did not determine Mechanic/Technician employees' 8-hour TWA exposure to chromium (VI) while the employees worked inside planes and ground/sanded on Alodine and primer coated surfaces (containing chromates) via handheld grinding tools.
