29 CFR 1926.106(a): Employee(s) working over or near water where the danger of drowning existed, was not provided with U.S. Coast Guard approved life jacket(s) or buoyant work vest(s). On or about April 9, 2019, the employer did not ensure an employee was provided and used a life jacket or buoyant work vest when operating a wheel loader on a temporary causeway constructed across a river, and where the river was approximately 20-25 feet deep. This exposed the employee to a drowning hazard.

29 CFR 1926.602(a)(3)(i): The employer moved or caused to be moved construction equipment or vehicles upon an access roadway or grade without ensuring the access roadway or grade was constructed and maintained to safely accommodate the movement of equipment and vehicles. On or about April 9, 2019, and times prior thereto, the employer allowed an employee to operate a wheel loader on a causeway that was not constructed to safely accommodate the movement of the wheel loader in that: a) after unloading rip-rap, the employee had to operate the wheel loader in reverse direction approximately 250-260 feet in order to exit the causeway, and; b) the edge of the causeway that lead into the 20-foot to 25-foot deep water was not sufficiently identified This exposed the employee to a caught-in hazard.
