29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. Located at Lot# 132, Flatiron Road (Preston Hall, subdivision), Westerville, Ohio: On or about May 13, 2020, the employer did not initiate and maintain a safety and health program to ensure hazard detection and correction, while employees performed framing work onsite.  One employee was observed at the unprotected edge of the roof top of the second floor level of a new build residential home, while he positioned to install the roof truss.  The fall distance was approximately 20 feet from the eave and truss to the ground level.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  a. Located at Lot# 132, Flatiron Road (Preston Hall, subdivision), Westerville, Ohio: On or about May 13, 2020, the employer failed to instruct employees on the avoidance of unsafe conditions while they performed framing work at a new build residential construction worksite.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a. Located at Lot# 132, Flatiron Road (Preston Hall, subdivision), Westerville, Ohio: On or about May 13, 2020,  the employer failed to ensure that an employee who worked from the roof top of the second floor level of a new build residential home was protected, while he positioned to install the roof truss.  The employee was exposed to a fall hazard of approximately 20 feet, from the unprotected side and edge near the eave of the roof top.
