29 CFR  1926.20(b)(1):The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:  a) Roberto Perez Construction LLC located at 4191 Pyke Drive Shawnee Hills, OH 43065:  On and preceding March 9, 2021, the employer did not develop and maintain an effective safety and health program to ensure that hazards were identified and corrected onsite while employees performed framing work.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) Roberto Perez Construction LLC located at 4191 Pyke Drive Shawnee Hills, OH 43065:  On and preceding March 9, 2021,  the employer did not ensure employees working at heights above 6 feet were protected from falls. Employees were performing framing work from the second story roof and standing on a window sill without fall protection, thereby exposing employees to a fall hazard of approximately 20 feet.  Roberto Perez Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13) which was contained in OSHA inspection number 1484966, citation number 1, item number 1 and was affirmed as a final order on 08/21/2020 , with respect to a workplace located at 3891 Pyke Dr Powell, OH 43065.  Roberto Perez Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13) which was contained in OSHA inspection number 1474940 , citation number 1, item number 3 and was affirmed as a final order on 8/21/2020 , with respect to a workplace located at 5766 Flatiron Roadlot# 132 Westerville, OH 43086.
