OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees.   a) On or about June 9, 2020; at the residential construction site in Bradenton, Florida.  Employees operated the Genie GTH-1056 extendable reach rough terrain forklift to hoist sheathing to the roof.  The forklift was not equipped with a seatbelt, exposing employees to a crushing hazard.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) For employees working at 1404-1418 58th Street W in Bradenton Florida as observed on or about June 9, 2020. Employees were using a portable ladder to access the roof to engage in roofing activities. The ladder side rails extended approximately 2 feet 7 inches above the upper landing surface. Employees were exposed to a fall height of over 9 feet.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a) For employees working at 1404-1418 58th Street W in Bradenton Florida as observed on or about June 9, 2020. Employees were removing and replacing roofing material on a 4:12 residential roof. The employees were not protected from falling by any fall protection system. Employees were exposed to a fall height of at least 9 feet.  The Florida Southern Roofing & Sheet Metal, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1345668, citation number 1, item number 1 and was affirmed as a final order on 5 February 2019, with respect to a workplace located at 6653 19th Street E, Sarasota Florida.
