29 CFR 1910.178(l)(4)(i): Refresher training, including an evaluation of the effectiveness of that training, shall be conducted as required by paragraph (l)(4)(ii) to ensure that the operator has the knowledge and skills needed to operate the powered industrial truck safely.  On or about September 8, 2020, the employer did not ensure that forklift operators in the warehouse were given refresher training and reevaluated every three years to ensure that operators were not driving with the forklift forks too high off the floor, and ensuring forklift horns were utilized when entering blind spots.

29 CFR 1910.178(n)(6): The driver shall be required to look in the direction of, and keep a clear view of the path of travel.  On or about September 8, 2020, the employer did not ensure that employees driving in and around row #060 had a clear view of the path of travel in that employees were not able to see around stacks of pallets, resulting in two forklifts colliding.
