29 CFR  1910.178(l)(4)(ii)(B):  Refresher training in relevant topics was not provided to the operator when the operator was involved in an accident or near-miss incident.  a. On or about March 2, 2021, in the facility, the employer failed to ensure that prior to allowing employees to operate a powered industrial vehicle after being involved in an accident, the affected employees were provided with refresher training. On September 19, 2020, two forklift operators were involved in an accident, and as of March 2, 2021, had not yet received refresher training.
