29 CFR  1926.502(b)(3): Guardrail systems were not capable of withstanding, without failure, a force of at least 200 pounds (890 N) applied within 2 inches (5.1 cm) of the top edge, in any outward or downward direction, at any point along the top edge:  a. On or about March 8, 2021, at the above addressed jobsite, two employees were working from a balcony with temporary guardrail system consisting of 2 x 4 that were not capable of withstanding, without failure, a force of at least 200 pounds applied within 2 inches of the top edge, thereby exposing the employees to a fall hazard of up to 12 feet to the concrete floor below.

29 CFR  1904.39(a)(2):The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye.  On or about March 8, 2021, at the above addressed jobsite, the employer did not report to OSHA the hospitalization of a worker in 24 hours, after an employee fell from a balcony.
