29 CFR  1926.503(c)(3):Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.  On or about May 12, 2021, employees engaged in roofing demonstrated inadequacies in their fall protection training.  This condition exposed employees to fall hazards greater than 6 feet from lower levels.

29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems,  or personal fall arrest systems:  On or about May 12, 2021, employees performing plastering work by the edge of the roof did not use any type of fall protection system. This condition exposed employees to fall hazards greater than six feet from lower levels.  Best Plastering Construction was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1247229, citation number 001, item number 001 and was affirmed as a final order on 12/19/2017, with respect to a workplace located at 14761 Sunny land, El Paso TX 7938.
