29 CFR  1910.110(f)(2)(ii): Liquefied petroleum gas container(s) stored inside were located near exits, stairways, or in areas normally used or intended for the safe exit of people:  On or about May 17, 2021, the employer failed to properly store liquefied petroleum gas (propane), as the wooden safety cage used for storage was placed near the rear exit door. Propane tanks are used to power the forklift.

29 CFR  1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial truck.  On or about May 17, 2021, the employer did not ensure the operator of the fork truck (Nissan Optimum 50 Forklift, propane powered) was properly trained and had successfully completed training requirements prior to operation.

29 CFR  1910.22(d)(1):  The employer did not ensure that walking-working surfaces were inspected, regularly and as necessary, and maintained in a safe condition:  On or about May 17, 2021, the employer failed to ensure that walking-working surfaces were maintained in a safe condition. The carpet in the main work area, inside the front door, is heavily worn, ripped and in disrepair.  This highly traveled working surface presented a tripping hazard to employees as well as hazardous condition for operating powered industrial vehicles.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  On or about May 17, 2021, the employer failed to train employees on the hazards of chemicals they work with, including, but not limited to, liquefied petroleum gas (propane). Propane tanks are used to power the forklift, and employees are exposed during use and storage in the common work areas.
