29 CFR  1903.19(d)(1):The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  Berea Farmers Exchange, LLC failed to provide documentation demonstrating the abatement methods and completion as cited in Citation 1 Item 1 for hazards associated with untrained powered industrial truck operators, and Citation 2 Item 1a/b for hazards associated with employee exposure to hazardous chemicals and no written hazard communication program or training.

29 CFR  1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial truck.  On or about November 10, 2022, the employer failed to ensure that the employee who operated the propane powered Nissan forklift had successfully completed the required training prior to the employee operating the forklift.  The Berea Farmers Exchange, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1910.178(l)(1)(ii), which was contained in OSHA inspection number 1531133, citation number 1, item number 2 and was affirmed as a final order on November 18, 2021, with respect to a workplace located at 394 W Bagley Rd, Berea, OH 44017.

29 CFR  1910.1200(e)(1): The employer did not develop, implement and maintain at the workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g) and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met.  On or about November 10, 2022, the employer did not develop, implement, and maintain a written hazard communication program. Employees drive a propane powered forklift with potential exposure to propane and carbon monoxide.
