29 CFR 1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale (slow response), or equivalently, a dose of fifty percent: The employer is failing to administer a hearing conservation program, which shall include the required elements of a noise monitoring program, an audiometric testing program, and a noise training program, to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 A-weighted decibels (dBA). This was most recently documented at 6955 McCormick Drive, Lincoln, Nebraska, with the following employee(s) exceeding the action level: (a) On July 15, 2021, an employee operating the grinders in the back warehouse was exposed to an 8-hour time-weighted average of 89.7 dBA, or an equivalent dose of 96.21%, for the sampling period of 472 minutes. A zero increment was included for the 8 minutes not sampled. Another employee operating the grinders was also exposed to an 8-hour time-weighted average sound level equaling or exceeding 85 dBA.

29 CFR 1910.1200(e)(1): The employer did not develop, implement and maintain at the workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g) and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the requirements listed in 1910.1200(e)(1)(i) and 1910.1200(e)(1)(ii): The employer is failing to protect employees from potential chemical exposure. This was most recently documented on July 13, 2021 in the facility located at 6955 McCormick Drive, Lincoln, Nebraska. The employer failed to develop a written hazard communication program. Employees in this facility used hazardous chemicals, which included but not limited to MEK, Loctite and spray paint. These chemicals can cause eye, skin and respiratory irritation if contacted or inhaled.

This was most recently documented on July 13, 2021 in the facility located at 6955 McCormick Drive in Lincoln, Nebraska. The employees used hazardous chemicals in the facility, but they were not properly informed of and effectively trained on hazardous chemicals in the facility. Chemicals used in the facility included but not limited to MEK, Loctite and spray paint. These chemicals can cause eye, skin and respiratory irritation if contacted or inhaled.
