Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards when using Rod Chomper Rebar Cutters & Benders - RCBRPG8 to bend metal rebars :  a) Worksite, 366 Broadway, Amityville NY 11701: Two employees tasked with using Rod Chomper Rebar Cutters & Benders - RCBRPG8 to bend metal rebars were exposed to struck-by hazards when standing in path of bending rebar; on or about 11/5/2021.  Note: In addition to abatement certification, the employer is required to submit abatement documentation for this violation in accordance with 29 CFR 1903.19.

29 CFR  1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  Worksite, 366 Broadway, Amityville NY 11701: Employees working with Rod Chomper Rebar Cutters & Benders - RCBRPG8 were not trained on the hazards associated with the equipment; on or about 11/5/2021.  Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
