29 CFR  1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each serious violation for which the Agency indicates in the citation that such abatement documentation is required.  a) On or about 8/28/2023, the employer did not submit abatement certification as required for citation 1 item 1, which was issued to the employer on 8/22/2023.  b) On or about 9/18/2023, the employer did not submit abatement certification and documentation as required for citation 1 item 2, which was issued to the employer on 8/22/2023.

OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards.  a) Worksite, 2380 Pond Road, Ronkonkoma, NY, 11779- Employee was exposed to the hazard of being struck-by the elevated bucket while installing Protector-Side Bars on the bucket of a Caterpillar 320E LRR excavator, on or about March 9, 2023.   Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR  1910.147(c)(1):The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:  a) Worksite, 2380 Pond Road, Ronkonkoma, NY, 11779- Employee was performing maintenance on a Caterpillar 320E LRR excavator by installing protector side bars on a severe duty bucket with the arm elevated in the air. The employee was struck by the bucket after a sudden release of hydraulic pressure dropped the bucket to the ground, on or about March 9, 2023.   Note:  In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
