29 CFR  1926.451(b)(3): General requirements. Scaffold platform construction. Except as provided in paragraphs (b)(3)(i) and (ii) of this section, the front edge of all platforms shall not be more than 14 inches (36 cm) from the face of the work, unless guardrail systems are erected along the front edge and/or personal fall arrest systems are used in accordance with paragraph (g) of this section to protect employees from falling.  a) On or about November 16, 2021, employees were utilizing a scaffold system with a front edge platform distance of 2 ft. from the working  area; without a guardrail system and a proper fall protection system in place.

Integral prefabricated scaffold access frames shall: Be specifically designed and constructed for use as ladder rungs.  a) On or about November 16, 2021, employees were utilizing an in-frame side ladder to access a tubular welded-frame scaffold system, measured at a height of approximately 26 ft. from a wooded deck area.  Such in-frame ladder was not specifically designed for use as ladder rungs.

29 CFR  1926.451(f)(7): General requirements. Use. Scaffolds shall be erected, moved, dismantled, or altered only under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. Such activities shall be performed only by experienced and trained employees selected for such work by the competent person.  a) On or about November 16, 2021, employees were working on repairs of a chimney, a crew leader in charge at the job-site, erected the scaffold system upon arriving at the job-site.  However, there was no competent person present at the job-site on this day during the time that the scaffold systems was being erected.

29 CFR  1926.451(g)(3)(iv): General requirements. Fall protection. Vertical lifelines, independent support lines, and suspension ropes shall not be attached to each other, nor shall they be attached to or use the same point of anchorage, nor shall they be attached to the same point on the scaffold or personal fall arrest system.  a) On or about November 16, 2021, an employee while working on the top tier of a tubular welded-frame scaffold was exposed to a fall hazard measured approximately 26 ft. from a wooded deck. The employee was utilizing two 2 ft. lanyards attached to each other and these lanyards were anchored in the top tier of the tubular welded-frame scaffold as fall protection.

When the employer has reason to believe: Where inadequacies in an affected employee's work involving scaffolds indicate that the employee has not retained the requisite proficiency.  a) On or about November 16, 2021 each employee working from the tubular welded-frame scaffold that have been previously trained on fall protection and the use of scaffolds did not retained the requisite proficiency and procedures to recognize and minimized hazards situations while erecting and using a tubular welded-frame scaffold erected over 20 feet.
