29 CFR  1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person:  (a) Roof - The employer did not have a competent person on the job site in that none of the employees who worked on the site on April 8, 2022 inspected the job site, identified predictable fall and struck-by hazards, and took immediate actions to correct the hazards.  As a result, employees did residential roofing work on a two-story single-family home with a single-story extension without using fall protection, exposing employees to the hazard of falling to a lower level.  In addition, employees did not wear eye protection when using or working near other employees using pneumatic nail guns to attach roofing materials and a leaf blower to remove debris, exposing employees to the hazard of getting struck in the eyes by flying particles/objects.  No abatement certification or documentation required.

29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:   (a) Roof - An employee used a leaf blower to blow roofing debris off the roof, and employees used pneumatic nail guns to install new roofing materials. The employees did not use any eye protection, exposing them to the hazard of getting struck in the eyes by flying particles/objects, on or about April 8, 2022.  No abatement certification or documentation required.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):   (a) Roof - Employees did roofing work, including tearing off old shingles and installing new shingles, on the two-story single-family home, which included a single-story extension.  The two-story portion of the house had an eave heigh of 17 feet 7 inches, the garage and front porch roof had an eave height of 8 feet 10 inches, and the single-story extension had an eave height of 9 feet.  The employees did not use guardrail systems, safety net systems, or personal fall arrest systems for fall protection nor did they use an alternative fall protection measure.  Instead, employees wore full body harnesses but did not tie off, exposing the employees to the hazard of falling from the roof to the ground below, on or about April 8, 2022.  No abatement certification or documentation required.
