OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that they were exposed to caught in and atmospheric hazards when entering confined spaces: Hillandale Farms doing business as Hillandale Farms Ohio, LLC located at 9715 Rosedale Road in Hicksville, Ohio 43526. On or about May 2, 2022, employees entering the pits of the dugout and doghouse for cleaning and maintenance tasks were exposed to caught in hazards associated with unguarded nip points of running conveyors and atmospheric hazards associated with the decomposition of chicken manure. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

Hillandale Farms, doing business as, Hillandale Farms Ohio, LLC at the site location of 9715 Rosedale Road in Hicksville, Ohio, 43526: On or about May 2, 2022, employees accessing the scrappers of the cross conveyors to perform maintenance, make adjustments to the belt tracking, or to observe the running belts in Manure Barn D were exposed to hazards associated with falls of approximately 17.5 feet. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR 1928.57(a)(6): Operating instructions. At the time of initial assignment and at least annually thereafter, the employer shall instruct every employee in the safe operation and servicing of all covered equipment with which he is or will be involved, including at least the following safe operating practices: I) Keep all guards in place when the machine is in operation per 1928.57(a)(6)(i); II) Permit no riders on farm field equipment other than persons required for instruction or assistance in machine operation per 1928.57(a)(6)(ii); III) Stop engine, disconnect the power source, and wait for all machine movement to stop before servicing, adjusting, cleaning, or unclogging the equipment, except where the machine must be running to be properly serviced or maintained, in which case the employer shall instruct employees as to all steps and procedures which are necessary to safely service or maintain the equipment per 1928.57(a)(6)(iii); IV) Make sure everyone is clear of machinery before starting the engine, engaging power, or operating the machine per 1928.57(a)(6)(iv); and, V) Lock out electrical power before performing maintenance or service on farmstead equipment per 1928.57(a)(6)(v). Hillandale Farms doing business as Hillandale Farms Ohio, LLC located at 9715 Rosedale Road in Hicksville, Ohio 43526. On or about May 2, 2022, the employer did not initially instruct employees in the safe operation and servicing of all covered equipment (including conveyors) to, among others, ensure safeguarding of operating machinery and safe distance from it during normal production. Safe practices for maintenance and servicing of equipment, including electrical power de-energization (lockout) were not established.
