29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): (a) On or about May 22, 2022, and at times prior at or near Charlson Madison South Unit Central Tank Battery in McKenzie County at or near Charlson in ND, while relighting the pilot light of a heater treater, employees were exposed to thermal burns where flash fires were present or likely to be present.

29 CFR 1910.1200(h)(3)(i): Methods and observations that may be used to detect the presence or release of a hazardous chemical in the work area (such as monitoring conducted by the employer, continuous monitoring devices, visual appearance or odor of hazardous chemicals when being released, etc.); (a) On or about May 22, 2022, and at times prior at or near Charlson Madison South Unit Central Tank Battery in McKenzie County at or near Charlson in ND, employees were not trained to check or monitor the gas Lower Explosive Limit (LEL) that may be trapped inside the firetube, prior to introducing an ignition source during the manual relighting process in the firetube of the heater treater. Trapped LEL could create the potential for flash fire hazards.
