On or before November 9, 2022, at the worksite located at 8428 Graystone Drive Pickerington Ohio 43147 Lot #12, the employer failed to initiate and maintain a safety and health program such as but not limited to a scaffolding safety program and fall protection program.

29 CFR  1926.451(c)(2):Supported scaffold poles, legs, posts, frames, and uprights shall bear on base plates and mud sills or other adequate firm foundation.  a. On or before November 9, 2022, at the worksite located at 8428 Graystone Drive Pickerington Ohio 43147 Lot #12, the employer did not provide base plates or mud sills for the scaffolding legs. The employees used the scaffolding without adequate firm foundation and rested the scaffolding legs on loose gravel, thereby being exposed to fall hazards of up to 12 feet.

29 CFR  1926.451(e)(1):When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access.  a. On or before November 9, 2022, at the worksite located at 8428 Graystone Drive Pickerington Ohio 43147 Lot #12, the employer did not provide a safe means of access to scaffold platforms. Employees used the edge sections of a scaffold frame to access the working platform, thereby being exposed to a fall hazard of heights up to 18 feet.

29 CFR  1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.   a. On or before November 9, 2022 at the worksite located at 8428 Graystone Drive Pickerington Ohio 43147 Lot #12, the employer did not ensure that the employees were protected while working on scaffolding while working at heights of over 10 feet to the lower level.  The employees were working on scaffolding at heights of greater than 10 feet without any means of fall protection thereby being exposed to fall hazards of up to 18 feet.
