29 CFR  1926.451(e)(2)(ii): Hook-on and attachable ladders shall be positioned so that their bottom rung is not more than 24 inches (61 cm) above the scaffold supporting level;    a.) On or about August 1, 2025, at the Gateway Lofts project, the employer failed to ensure that the frame scaffold hook-on ladder was positioned with its bottom rung no more than 24 inches above the scaffold supporting level. As a result, employees transitioning to and from the ladder were exposed to a fall hazard of approximately 18 feet.

29 CFR  1926.451(f)(3):Scaffolds and scaffold components shall be inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity.  a.) On or about August 1, 2025, located at the the Gateway Lofts project the employer did not conduct adequate inspections of the scaffolding in that they failed to identify several visible defects including:  absence of stacking pins in the frame of the scaffolding system, absence of the top-tier ladder for ingress/egress the scaffolding, and inadequate fall protection on the third level of the scaffolding system. As a result employees were exposed to a fall hazard of 18' while working from the frame scaffolding.

29 CFR  1926.451(g)(4)(iv): When midrails are used, they shall be installed at a height approximately midway between the top edge of the guardrail system and the platform surface.   a.) On or about August 1, 2025, located at the the Gateway Lofts project the employer did not ensure that the frame scaffolding guardrail system had mid-rails installed on the North end top level of the scaffolding and as a result, employees were exposed to a fall hazard of 18'.

29 CFR  1926.452(c)(3): Frames and panels shall be joined together vertically by coupling or stacking pins or equivalent means.   a.) On or about August 1, 2025, located at the the Gateway Lofts project the employer did not ensure that the frame scaffolding system was joined together by stacking pins in that the employer was missing stacking pins in multiple locations of the scaffolding to prevent the bucks from becoming dislodged and as a result, employees working on the 18' scaffolding were exposed to a potential collapse hazard.
