29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a. A welder in the southside of the Manufacturing Plant was exposed to a noise dose of 100%, or an equivalent dBA of 90 dBA, which was capable of causing permanent hearing loss. The sampling was performed for 400 minutes during one shift on March 31, 2023. The employer did not have a continuing, effective hearing conservation program.

29 CFR 1910.1000(a)(2): An employee was exposed to an airborne concentration of Particulates Not Otherwise Regulated (PNOR) listed in Table Z-1 in excess of the 8 hour Time Weighted Average concentration of 15 milligrams per cubic meter in air (mg/m�): a. Powder coating area: On March 9, 2023, the employer exposed a painter to an 8-hour calculated Time Weighted Average (TWA) of 17.2 mg/m� which is 1.14 times the 8-hour TWA Permissible Exposure Level (PEL) of 15 mg/m� while applying powder coating. Results were calculated based on the 269 minute sampling period.
