Linden Street in Abbotsford, WI; the employer, Packers Sanitation Services, Inc., did not evaluate the workplace to determine in any spaces were permit-required confined spaces. The employer did not evaluate if confined spaces it assigned its employees to conduct sanitation work in were permit-required confined spaces. The employer did not evaluate permit-required confined spaces including, but not limited to the freezer in RTE-3, the freezers in RTE-2, or the Spiral oven, and Double D1 oven in Forming.

On or about January 26, 2023, at a facility located at 502 E. Linden Street in Abbotsford, WI; Employees conducting sanitation on equipment, such as but not limited to the RTE-3 freezer, the RTE-2 freezer, the Forming Spiral oven, and Double D1 oven, were not informed by posted danger signs or by any other equally effective means of the existence of those permit spaces or the hazards posed by those permit spaces.

The written program shall be available for inspection by employees and their authorized representatives: On or about January 26, 2023, at a facility located at 502 E. Linden Street in Abbotsford, WI; the employer directed their employees to enter and conduct sanitation work in the permit-required confined spaces (PRCS) of the RTE-2 freezers, RTE-3 freezer, the Forming Spiral oven and Forming Double D1 oven. The employer did not develop or implement a written permit space program prior to employees working in those PRCS.

29 CFR 1910.147(c)(8): Lockout or tagout shall be performed only by the authorized employees who are performing the servicing or maintenance: On or about January 26, 2023, at a facility located at 502 E. Linden Street in Abbotsford, WI; lockout was no performed only by the authorized employees who were performing servicing and maintenance. Employees conducting sanitation on machines did not affix their own locks to the energy control devices for the equipment they were performing servicing and maintenance on: a) An employee cleaning the East and West Mixers in BG-4 did not conduct lockout procedures and did not affix their own lock to the chain restrains on the mixers' exit doors or on the electrical disconnects for the mixers' augers. b) Two employees cleaning the East Mixer in BG-2 did not conduct lockout procedures and did not affix their own lock to the electrical disconnects for the mixer's equipment in the upstairs electrical panels area.

29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6): (a) On or about January 27, 2023, employees were exposed to machine hazards associated with moving parts when they engaged in sanitation activities on the east mixer in BG-2. The employer did not ensure that employees implemented energy control application steps or equivalent protective measures prior to allowing them to clean and sanitize the mixer which exposed employees to the energized pneumatically powered exit doors on the mixer. The machine was not deenergized prior to the employee engaging in the servicing / maintenance activity. (b) On or about January 27, 2023, employees were exposed to machine hazards associated with moving parts when they engaged in demonstrating sanitation by turning the west mixer's auger in BG-4 with a metal rod. The employer did not ensure that employees implemented energy control application steps or equivalent protective measures prior to allowing them to demonstrate sanitation of the mixer which exposed employees to potential electrical energization of the auger. The machine was not deenergized prior to the employee engaging in the servicing / maintenance activity. (c) On or about January 26, 2023, employees were exposed to machine hazards associated with moving parts when they engaged in sanitation activities in the Forming area's ovens. The employer did not ensure that employees implemented energy control application steps or equivalent protective measures prior to allowing them to clean and sanitize the FMC oven, Double D1 oven, IR oven or Spiral oven, which exposed employees to the energized conveyors of the ovens. The machine was not deenergized prior to the employee engaging in the servicing / maintenance activity. As a result, the remaining applicable energy control elements, involving machine isolation [1910.147(d)(3)], lockout/tagout device application [1910.147(d)(4)], dissipation of residual energy [1910(d)(5)(i)], and verification of isolation [1910.147(d)(6)] were not implemented to protect employees from machine hazards.
